All of this brings up the question for me
of when structure lost its status as part of the product? You're not the first
to suggest in this conversation that it has.
I guess it depends on what you mean by "structure". When you talk about the layout - arrangements of frames on the pages, paragraph definitions etc. - and it has taken signifcant time on the client's clock to develop, I'd agree that it is part of the product.
But you could also talk about the general structure of the document - say, a phone manual starting with making a call and continuing with receiving a call. I would argue that this kind of structure is so much forced by the product that it normally is not protectable and that the client does not gain any rights to it. It falls under the general "things I've learned" category.
