What if the product is only going to be used in-house, but has the same or similar name to a commercial application?
From a trademark point-of-view, ther should be no problem: If you use something in-house only, you do not trade it, hence no trademark issues.
However.... if the name of your in-house product becomes public knowledge, for example through a feature article on your company, your company could probably be sued by the trademark holder.
Anyway, why would you want to have something inhouse that has the same name as a commercial product with the same functionality? ("I'm going to send you an Excel spreadsheet." - "Uh - our Excel or Microsoft's?")
