> Does the NDA still apply when
> eHelp is actually selling the software already?
When they are selling it? Almost definitely.
When they are *shipping* it? Good chance, so check the details of the NDA.
Depending on the depth of testing the person/company was doing, there could
still be proprietary information that was discovered which is still (and
always will be) covered by the NDA.
Talking about the results of the testing could be a breach. Again, this is
where you would definitely want to read over all the details of the NDA.
MY PERSONAL OPINION (others might/will disagree) - professionalism dictates
that after I am released from the letter of the NDA I still should protect
the spirit of the NDA and not discuss product details ever.
As for the original post where the person discussed Mustang - I raised my
eyebrows when I read it. Imagine if eHelp only enlisted one company and had
them sign the NDA. Tracing the posting back to that one company would be
pretty easy, and they would be liable.
I remember a friend of mine whose favorite saying was "discretion is the
highest form of valour." For me, that would apply to this situation.
But.... that's just me. :-)
