It's more complicated than that. You can have an EIN and in a particular
instance be ruled an employee.

Even if you have liability, along with that EIN, you may still be an
employee.

Many of the points being raised are related. Other points are un-related,
but still make good sense, like carrying liability insurance.

Check with a competent lawyer who practices in this particular area. Also
check with the IRS about the 20 questions and how they are applied.

Every situation is different.
