One example I've seen for mandating the use:The original sentence states that the estate is to be equally divided between the three men. If the estate were to be divided according to your second sentence, then the first sentence would read "My estate is to be split equally between Tom, and Dick and Harry."
"My estate is to be split equally between Tom, Dick and Harry." In this
instance Tom gets 50% and Dick and Harry get 50% to argue over. If it was
presented as: "My estate is to be split equally between Tom, Dick, and
Harry." each would receive a third of the estate.
