Trademarks are not issued by courts. The courts, however,
do have the final say on whether trademarks issued by the
govt are valid. The MS trademark on "Windows" is not
fully settled in law at this time.
MS eventually settled the case and paid Lindows
$24,000,000 for its name (the company is now called
Linspire) to avoid having the courts issue their final
ruling on Lindows' claim that "windows" was a generic
term in the software industry prior to the introduction
of MS Windows.
