I think companies that are inclined to abuse labor and tax laws are more likely to do it to W2 employees and people who really want to be W2 employees they have deliberately misclassified as 1099. Those people either fear losing their jobs or their chance to turn their "contract" into a job. But they usually know that people who work 1099 independent contractor by choice are more likely to know the laws and to be willing to walk away from a contract and exercise their option to sic government agencies on them.

OTOH, there are a lot of companies, especially small ones, where managers really don't know the difference between W2 and 1099 because nobody has ever taken the time to explain it to them.
