Actually I suspect it has to do more with the changing nature of the
client/agency relationship. Every agency that has contacted me in the last
two months has stipulated the importance of not bailing before the contract
starts. Up until a few months ago, nobody ever even mentioned it! I found
out that most of the large employers here in Charlotte now use automated
vendor management systems, and all them penalize the agencies when someone
accepts a contract position and fails to show up. I agree that it is a
pretty cheap and sleazy attempt to pass that penalty to the contractors who
actually provide their bread and butter.
Unless they're paying you a signing bonus or relo, it's really
unconscionable. I know I would drop an agency that tried to slip that in.
However, you need to go with your gut as to whether to try to cut it out of
the contract, or drop your relationship with the agency altogether.
