Oops, I should have been clearer. I didn't mean to say
that you can go both ways on a given contract (i.e. as
an employee and as a contractor). What I should have
said was that your status as a non-employee of the
client is clear if you use an agency, which is how
agencies came into existence.

The other point I wanted to make is that there are
agencies that provide the back office billing and
payroll services without tacking on a huge margin,
working instead for a fixed percentage. In other
words, there are agencies, and then there are
agencies. You don't have much choice if you get your
work from agencies who find you. But if you have a
direct relationship with a client who wants to hire
you, you can use a payroll service agency. Both you
and the client come out ahead financially.
