That's a new one on me, although I am not surprised. I wonder what the written test discrimination claim was about.
Discriminated on basis of writing ability? Choice of one thing over another is done either by discriminating on perceived criteria, or else by chance.
Anyone can sue for anything, and in the US can often hire a lawyer on contingency with no downside risk.
I remember a suit by someone who felt she was passed over for "promotion" to tech writer. She was working as a typist, and had not applied for the position. Indeed, even if she had, she would not have been chosen, because she was an abrasive person!
