Now just a dadburn minute. If I ask you to hand me a Kleenex, is a
paper towel going to be your first choice? Will you actually consider
toilet paper? OK, seriously: use and refer to your company's or
client's trademarks properly. You are under no obligation to do
anything about other company's TMs. Therefore, you choose who you want
to oblige - business partners, etc. - and do it.
Worry about being sued? You have to have great influence in the market
for anyone to spend the bucks trying to get you to stop doing
something. Besides, you'd probably stop as soon as they ask, right?

In any case, it's simply bad writing, as the term "Kleenex," as used, is
ambiguous. I don't know if you mean facial tissue, toilet tissue, or a paper
towel that happened to be handy in an emergency. The word is useless in that
context, as replacing it with "Snarglethweep" would convey almost the same
information.
