A related area of concern is ownership of anything you write, invent,
develop, etc. on your own time. Writers, programmers, artists, and other
people who might have a "profitable hobby" need to discuss this with
prospective employers and, if necessary, have appropriate wording added
to their employment agreement. The courts have been inconsistent in
protecting the personal intellectual property of employees from being
looted by their employers, and a legal battle could be expensive even if
the law appears to be on your side.
Another touchy area is writing articles for magazines, trade
publications. Some employers insist on clearing everything you write,
even if it has no bearing on their business. This needs to be discussed
at interview time also.
