The extra comma makes a portion of the sentence parenthetical. That
portion can then be removed from the sentence, changing the original
intent of the writer. Apparently, the extra comma affects whether the
termination applies to the original five-year period or the successive
five-year periods.

If the sentence had been written in plain, simple English, the problem
would most likely not have occurred. In other words, "legalese" is the
source of the problem.

Of course, if legal documents were written in plain English, we wouldn't
need lawyers to interpret them for us, would we? Hence the importance
of legalese to lawyers!
